PHOTOGRAPHY CONTRACT

1. PHOTOGRAPHY ORDER: This signed Contract constitutes an order for photography in the form of photographs, proofs, negative films, and digital images as ordered. There is no oral or other agreement of the parties hereto and this Contract constitutes full and complete understanding and agreement between the Client noted below and the Photographer,Glass Photography.

2. LIMIT OF LIABILITY: Although care will be taken with the negatives and photographs taken on the photography session dates noted below, Photographer limits any liability for loss, damage or failure to deliver photographs for any reason on behalf of Photographer, agents, assigns or licensees for their nonperformance caused by any force majored of similar circumstances, illness, accident or any cause beyond their control; nor for the loss or damage of any photographic materials, whether in transit or in developing to return of money paid by Client for each un-produced shot. In any event, the limit of Photographer's liability shall not exceed the contract price stated herein.

3. EXCLUSIVE PHOTOGRAPHER: It is understood that no other photographer, amateur or professional shall be appointed to photograph on the photography seeion dates while the Photographer is working, and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to the Photographer and loss of Retain Fee by Client. Family, friends and quests may take snapshots, but no one else may be appointed to functions as an official photographer of the day's events.

4. OWNERSHIP OF NEGATIVES: It is agreed that ownership of the negatives will transfer to the Client upon delivery of the wedding photography package ordered on this Contract. However, the Photographer retains the display promotion permissions described in Provisions #5 below and the copyrights of the negative images even though the Client owns the physical negatives.

5. DISPLAY PROMOTIONS: It is agreed that the Photographer may display and use photographs taken consistent with this Contract and its amendments, if any for including, but not limited to: advertising, display, website and internet promotion, photographic contests, bridal shows, public display as in malls, photography books, photography instructional books, store fronts, window displays, studio displays, television advertising, magazine advertising and any other purposes thought proper by the Photographer.

6. RETAINER FEE AND PAYMENT SCHEDULE: Upon signature of this Contract, the Photographer (John Glass reserves the time and date agreed upon, and will not make other reservations for the time and date. For this reason, the Retainer Fee of $200.00 is non-refundable, even if date is changed or wedding cancelled for any reason, including acts of God, fire, strike, extreme weather. Retainer Fee is to be paid at time of parties signing this Contract. Retainer Fee is applied towards the contracted photography package upon completion of this contract. Client understands and agrees that the one half of contracted package be paid 21 days prior to the photography session. Client understands and agrees that the remaining one half of the payment be paid at least two (2) the day prior to the photography session. Client agrees without balance paid by this time, the Photographer will NOT photograph the photography session described on this Contract with no liability to Photographer and loss of Retainer Fee by Client.

7. GUARANTEED DELIVERY TIME: Photographer agrees to have the contracted order for photographs completed within six to eight weeks of photography session unless 24 hour turnover has been agreed upon and paid for. Also any other photographic orders will be completed within 6 weeks of order placement. This guaranteed delivery time is dependent upon Photographer having ALL the negatives in its physical control. Client understands and agrees that certain photography orders may take between 8 to 10 weeks for delivery.

8. INDEPENDENT CONTRACTOR: This contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.

9. GOVERNING LAW OF CONTRACT: the laws of the State of Michigan shall govern this contract.

10. CANCELLATION: In the event the Client must cancel the contracted services for wedding photography of this Contract, the Photographer agrees to refund all money paid, excluding the Retainer Fee of $200.00 if cancelled more than 21 days from date of wedding. If less than 21 days one half of the total package will be retained. Photographer will provide receipts to Client for all money paid.

11. ALTERNATE PROFESSIONAL PHOTOGRAPHER: In the event the Photographer, (John Glass) cannot perform due to illness, injury, or any other cause beyond control, the Photographer agrees to provide an alternate photographer to perform under this Contract. The Photographer warrants that the alternate photographer is a competent and experienced wedding photographer.

ALL TERMS OF THIS PHOTOGRAPHY CONTRACT ARE UNDERSTOOD AND AGREED UPON BY SIGNING PARTIES.
